As a result of their service in a tree removal, my pond was polluted and 5 of my 16 to 18 inch koi died. Contacted their office and still no resolution.

Upon the service of a tree removal, October 12th 2010, my personal property was damaged. To begin with, I am a renter at this address so the company organized the service with my landlord. The company did not inform me of the date for the service. They just showed up without warning. I had informed the workers that I had a pond near the tree. I asked them about covering it to keep it protected and they said that they had plastic to cover it. Instead of getting the plastic or asking me to make other arrangements, they began cutting down the tree without regard for my 400 gallon pond. The following morning, I went out to feed my koi and found that 5 were dead. The pond water had turned reddish from the wood chippings of the chainsaws when cutting down the tree. I tried contacting the company representative, Leonard, that morning on this issue and he said they would get back to me. After not hearing from them, I called back a week later to which they said that they were working on it and would be in contact with me. Another week later, I called them again because they were not calling me. I talked to Leonard and informed him of the value of my fish. He offered me $250 because business was slow for them so he would not be able to cover the full damages to my property. To be understanding, I was willing to accept $350 because full value would have equaled over $500 and I wanted to be fair in this situation. I suggested that they should turn this event over to their insurance and that is the last I heard from the company. Needless to say the issue has not been resolved, November 17th 2010.

I would like their company to reply to my messages in this matter. Ultimately I would like to be compensated for the lost of my personal property (i.e. 5 koi). After researching the value of my kois' length, age, and species, from Mystic Koi and Water Garden in Upland, California the specialist informed me that my fish were worth between $100 to $150 each.
