Breaking New York Laws with Their Sales Conditions
They break many Consumer Protection Laws in New York State, specifically article 25 which regulates Arts and Cultural Affairs that are held in Ticketed Venues. I have summarized the regulations which VIPNation has broken, which I noticed when I purchased Madonna tickets for her concert being held in Yankee Stadium on 9/8/12 25.01 - Regardless of where the ticket sellers are located, if they hold an event in New York State, they are subject to these laws 25.13.2 - No operators shall sell tickets with an obstructed view and shall disclose the exact location of the seat so as to prove the seat is unobstructed 25.19 - Posting of price lists, information to the purchaser, shall be conspicuously posted in all bureaus, offices, agency, or sub agency, which is to be displayed at times reflecting the prices charged by the person, firm, place of amusement etc. together with the price being charged for each seat. The ticketing agency must also upon request furnish each purchaser of a ticket with a receipt showing the same location information and price for the seat purchased. If the ticket is sold through the internet a image of link must be displayed on the page on which tickets are accessed, clearly detailing the location and price of the seat as required by section 25.07. 25.30 - It is prohibited to restrict the resale of tickets as a condition of purchase, as a condition to retain such tickets, or to deny access to a ticket holder who possess a resold ticket. It is also prohibited to employ a paperless ticketing system unless the consumer can transfer at any price, and at any given time. and with out any additional fees. The ability to acquire a physical ticket must be provided as an option from the vendor, and the vendor shall not constitute a special service or charge pursuant to 25.29 of this article. Futher, a patron that possess a legitimate ticket, can not be turned away if the ticket was resold and does not have their name printed on said ticket. VIPNation did not post a clear seating chart, the sections they named during the purchase process were reserved bowl, and reserved floor. These words did not appear on the seating chart at all. Further more all ticketing was done online, with no option to purchase a physical ticket. As soon as I completed my purchase I called their toll free line to inquire where these reserved sections were as they were not on the provided chart. They could not tell me. They said they don't know until the day of the show. I then asked them to provide me with a physical ticket (as I have the right to do). As I had just paid an significant premium for their "VIP" seats, yet do not know where these seats are. They replied they can not and will not provide me with a physical ticket until I arrive at the show. This is unexceptionable and illegal. Furthermore, they told me that I have to be there with photo id, anyone who's id does not match that of the person who's name is on the ticket will not be let into the concert, and resales are prohibited - also against NY law
